Following amendments made to the Regulations to the Deeds Registries Act published on 5 March 2025, the Deeds Office now requires Form LLL to be lodged “for statistical and land audit purposes relating to land ownership in South Africa”. The newly amended Regulation 18 now calls for the collection of personal data relating to the race, gender, citizenship and nationality of landowners.

Form LLL mandates disclosure

Form LLL requires disclosure of, inter alia, a purchaser’s race, gender, nationality, and where applicable, passport number and permanent residency status. Where land is not being transferred (for example, where an owner is applying for a certificate of registered title), the form must be completed and signed by the registered owner.

In instances where the purchaser or registered owner is a company, trust, or close corporation, the form must be completed by indicating the majority race, gender and nationality of those who hold ownership of the entity, i.e. the shareholders, beneficiaries or members.

Regulation 18

Form LLL must be completed and signed by the purchaser or registered owner. However, Regulation 18 does provide that an attorney, conveyancer, notary public or statutory officer may sign the form on the client’s behalf on information received. It is, however, critical that the practitioner acquires accurate information from the client before signing the form.

CRC 3 of 2025 provides further clarity on the changes to Regulation 18. From 5 April 2025, Form LLL must be lodged with all deeds or documents pertaining to land, mortgage bond, and notarial bond registrations in the Deeds Office. The form must be stapled to the inside of the lodgement cover and is to be returned to the practitioner after the data has been captured by the Deeds Office.

Information only used for statistical and land audit purposes

Importantly, both Regulation 18 and CRC 3 of 2025 state that information relating to a party’s gender, race, nationality, and permanent residency status must not be disclosed in any other deed or document lodged, as the information is only to be used for statistical and land audit purposes.
